1.2 This agreement includes any application form completed by you, or completed by us on your behalf.
1.3 It also includes any verbal application made by you and recorded by us or sent via e-mail or Fax correspondence.
1.4 The agreement is covered by our current price list which can change from time to time. Current prices are available from us on request.
1.5 Our pricing is also based on all proposals submitted to customer & signed off by customer which includes any consultative work.
1.6 All consultation fees are payable at the time of customer signing contracts.
1.7 All consultation fees & charges will be be calculated on the rates, fees & charges for which the customer signs up for minus the old rates, fees & charges calculated annualy and for the full period of the contract.
e.g. Current Phone Bill: Comprises of Line Rental & call usage costs.
Current Bill: $2,000.00 X12 months = $24 000 PA Cost to customer
2waytelecoms Consultation Fees are based on savings therefore each percentage savings calculated yearly which 2waytelecom saves the customer a 20% fee of the Total Annual Savings they demonstrate is applicable for each year per line of service. i.e. Line Rental is one line of Service. Usage Cost is another seperate line of service.
Each service savings will be added up individually & calculated on a PA basis for the duration of the contract. i.e. A Three Year contract equals a three year annual acrude savings & customer is liable to pay for the full 3 years of savings.
e.g. New Rates ( 2waytelecom recommended rates) demonstrates a 31% Savings based on 1.7 figures of $24000 PA, ( $1,380 X12 Months = $16, 560 Annual Savings which customer will achive as a result of 2waytelecom advise & consultation.)
Total customer savings therfore equals $7,440 PA or $22,320 over 3 Year Contract.
2waytelecom consultation Fee is 20% which equals a fee of $4,464.00 Ex GST (3 year contract)
Therefore total customer Savings $22,320 -$4,464.00 = $17,856.00 Total Customer savings after 2waytelecom fees are paid.

2.0 Service Description ,Terms & Indemnity:
2.1.1 2waytelecom will recommend a telephone or Data service via a carrier network or networks nominated by us.
2.1.2 Customers, vendor's or reseller's indemnify 2waytelecom from all losses, damages, costs or expenses which the customer, vendor or reseller may incur.
2.2 When 2waytelecom supplies your mobile phone service, we will complete the connection to the network as soon as possible.
2.3 When 2waytelecom supplies your mobile phone service, the recommended carrier will provide you with a new SIM card.
2.4 This SIM card will be activated upon your request or within 15 days, whichever comes first.
2.5 When 2waytelecom supplies or recommends your Data or Internet service, a rented CPE router will be supplied by us or our partners, for your use.
2.6 You must not personally resell any of your services supplied by us to a third party without our permission in writing.
2.7 Each nominated carrier has their own individual service level agreement.
2.8 2waytelecom supply a copy of all SLA's to the customer on signining of the contract.
2.9 2waytelecom will not be liable for any loss of service or damages as a result of the nominated provider experiencing any service issues.
2.10 2waytelecom have a copy of all SLA on file & if you wish to receive a copy kindly contact your account manager accordingly.
2.11 2waytelecom cannot gaurantee any nominated vendors workmanship or service qaulity or reliability.
3.0 Charges & Payment
3.1 You will receive an invoice for all calls, services, usage costs, access costs and any other charges, and have 14 days to pay your account. Occasionally, due to network processing, charges from previous months can appear on your current account.
3.2 If 2waytelecom provides your mobile phone , voice or data service, you may also be charged for
a) Any minimum monthly spend applicable to your plan or monthly commitment.
b) Charges for any value added services.
3.3 If you receive any charges from your previous supplier you will need to pay those amounts.
3.4 Charges can involve fees for connection, activation or cancellation of services.
3.5 In relation to Mobile Services, you remain liable for all calls made from your handset, including any calls made in error.
3.6 Additional charges can be incurred for accounts not paid by the due date.
3.7 We can deactivate, cancel or restrict services if the account is not paid by the due date. If you have nominated Direct Debit, your bank A/C or credit card will be charged as close as possible to 14 days from the invoice date.
3.8 There are charges involved to reprint bills.
3.9 if you do not pay your account, we reserve the right to disclose personal information about you to assist in the recovery of monies owing.
3.10 if you pay your account by American Express or Diners Club a 3% surcharge is applied.
3.11 if you pay your account by Visa or MasterCard a 1% surcharge will be applied.
3.12 if you do not pay your account we reserve the right to place your debt in the hands of a registered Debt Collection Agency which will assume responsibility for collecting monies owing, and a 25% surcharge and/or legal fees can be charged.
3.14 if your account is connected to the 2waytelecom and or any of our partner’s network's and you cancel the Direct Debit payment
method your account will be charged a Monthly Manual Payment Surcharge of $20.00 ex Gst.
3.15
i) Should 2waytelecom re-bill a service to your company , it reservers the right to on -bill those charges to your business for services rendered & received & all applicable charges are payable.
3.15.
ii) Further Fees and Charges includes, Sensis Directory listing a 10% administration fee will be charged.
3.16 For accounts that have Direct Debit payment options applied; if the Direct Debit payment is
Dishonored or rejected then a dishonor fee of $40.00 will be applied to the account.
3.17 Should you wish to cancel any contract via early termination a cancellation fee will apply:
i) Voice - Full Contract value payout is applicable.
ii) Data & Internet – Full contract value payout is applicable.
iii) Mobiles – Full contract value payout is applicable.
4.0 GST
4.1 Unless stated otherwise, at prices quoted to you will exclude GST.
5.0 Transfer to Us
5.1 By signing any 2waytelecom applications forms or partner's application forms for voice, data, internet, mobile application, you are authorizing us to act on your behalf and to transfer your services from your current suppliers across to 2waytelecom & or our partners networks.
6.0. Should any customer of 2waytelecom Pty Ltd wish to cancel any services , they will be required to pay out the remainder of their contract term in full before hand. An invoice will be sent out immidiately & full payment will be required within 14 days of invoice being submitted.
